SENIORITY UPDATE

June 27,2008

Dear Brothers and Sisters,

Many of you may already have learned that the BC LRB (Labour Relations Board) has rendered a decision on Local 155’s Seniority issue June 19, 2008. The full version of the decision is available at the website address provided in the following link http://www.lrb.bc.ca/decisions/B098$2008.pdf

We also have an electronic version of our lawyers’ submission to the LRB and the Producers lawyers’ submission if you would like a copy.

The Union’s submission to the B.C. LRB was to the effect that the referral of Local 155’s Seniority dispatch issue to Vince Ready (Clause 19 of the Memorandum of agreement) came out of the collective bargaining process, not from the Collective Agreement.

The Union’s argument has been consistent saying, if the referral of the Seniority issue to Vince Ready came out of collective bargaining, issues or concerns flowing from the Vince Ready decision could then be put before the jurisdiction of the British Columbia Courts to hear and decide.

Unfortunately we were not successful in our endeavor. The BC LRB concluded in their decision that the referral to Ready came out of a Collective Agreement and subsequently dismissing the Union’s application.

In regards to immediate changes, please be advised that there are still unresolved issues surrounding the clarification of the Vince Ready decision and outstanding Section 99 filed with the BC LRB. Local 155’s structure and the way we operate will continue with status quo in effect. The Union will be consulting with their legal counsel on how to proceed from this point. In the meantime please be assured the Union has not given up, and will be investigating other options to reverse this tragic wrongdoing.
